How is end of service gratuity calculated in the UAE?

Under Federal Decree-Law 33/2021 (Article 51), gratuity is 21 days of basic salary per year for the first 5 years, and 30 days per year after that. The total is capped at 2 years of basic salary. Only basic salary counts — housing, transport, and other allowances are excluded.

Do I get less gratuity if I resign?

No. Under the 2022 UAE Labour Law reform (Federal Decree-Law 33/2021), the old rule that reduced gratuity for resignation before 5 years has been abolished. You receive full gratuity regardless of whether you resign or are terminated, as long as you completed at least 1 year of continuous service.

What is the minimum service for UAE gratuity?

You must complete at least 1 year of continuous service to qualify for end of service gratuity. Employees who leave during probation do not qualify.

Does gratuity apply in DIFC?

DIFC replaced end of service gratuity with the DEWS (DIFC Employee Workplace Savings) pension plan from 1 February 2020. Employers contribute 5.83% of basic salary for under 5 years of service or 8.33% for 5+ years. Pre-2020 service may have a legacy gratuity balance.

When must my employer pay gratuity?

Under Article 53 of Federal Decree-Law 33/2021, your employer must pay all final dues including gratuity within 14 days of contract end. In ADGM, the deadline is 21 calendar days.
